TERMS OF SERVICE

These Terms of Service govern your use of the Castara website located at castara.io and any services provided by Castara, a brand of Bessen International LLC, located at 1001 S Main Street, Ste 49, Kalispell, MT 59901, United States. By accessing our website or purchasing our services, you agree to be bound by these terms.

1. Services

Castara provides a Website as a Service (WaaS) offering that includes design, development, hosting, maintenance, and accessibility compliance management for business websites. Services are provided on a subscription basis, either monthly or annually, as outlined in the pricing presented on our website.

Specific deliverables include:

• A single-page static website built to WCAG 2.2 AA accessibility standards
• Hosting on enterprise-grade VPS infrastructure
• Version control via GitHub for audit trail and code history
• WAVE accessibility audit results published on your website
• Schema markup and SEO optimization
• Up to 5 content or copy change requests per calendar month

2. Payment and Billing

Monthly subscriptions are billed on a recurring monthly basis. Annual subscriptions are billed as a single upfront payment at the annual rate. A one-time setup fee applies to all plans as stated at the time of purchase. All fees are non-refundable unless otherwise stated in writing by Castara.

Failure to pay may result in suspension of your website. Castara reserves the right to adjust pricing with 30 days written notice.

3. Client Responsibilities

As a client, you are responsible for:

• Providing accurate business information, copy, logo, and branding materials required for your website
• Ensuring that all content you provide does not infringe on third-party intellectual property rights
• Submitting change requests within the monthly limit of 5 requests
• Reviewing and approving your website before launch
• Consulting a qualified attorney for any legal compliance questions specific to your business

4. Intellectual Property

Upon full payment, you retain ownership of your business name, logo, and the content you provide. Castara retains ownership of the underlying code architecture, templates, and development methodology. You are granted a non-exclusive license to use the deployed website for the duration of your active subscription.

If your subscription ends, your website will be taken offline. You may request a copy of your site content at any time.

5. No CMS Policy

Castara websites do not include a content management system (CMS). This is a deliberate product decision to maintain WCAG 2.2 AA compliance and code integrity. You may not request CMS access as part of any Castara plan. All changes are submitted as requests and handled by Castara.

6. Cancellation

Monthly subscriptions may be cancelled at any time with 30 days written notice sent to contact@castara.io. Your website will remain active until the end of the current billing period. Annual subscriptions are non-cancellable for the contracted term but will not auto-renew without your confirmation.

7. Limitation of Liability

Castara and Bessen International LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of revenue, loss of business, or legal claims made against your business. Our total liability to you for any claim shall not exceed the total fees paid by you in the 3 months preceding the claim.

8. Modifications

Castara reserves the right to update these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms. We will notify active clients of material changes by email.

9. Governing Law

These Terms are governed by the laws of the State of Montana, United States. Any disputes shall be resolved in the courts of Flathead County, Montana.

PRIVACY POLICY

This Privacy Policy describes how Castara, a brand of Bessen International LLC, collects, uses, and protects information when you visit castara.io or engage with our services. We are committed to handling your data with transparency and care.

1. Information We Collect

We collect information in the following ways:

• Information you provide directly: When you fill out our contact or booking form (hosted by HubSpot), we collect your name, email address, phone number, business name, and any details you include in your message.
• Automatically collected data: Our hosting infrastructure may collect standard server logs including IP addresses, browser type, referring URLs, and pages visited. This data is used for security and performance monitoring only.
• No cookies from Castara: The castara.io website itself does not use tracking cookies or analytics scripts. Third-party tools such as HubSpot may set their own cookies subject to their own privacy policies.

2. How We Use Your Information

Information you provide is used solely to:

• Respond to your inquiry or booking request
• Deliver and manage the services you purchase
• Send service-related communications such as invoices, updates, and renewal notices
• Improve our service offering based on aggregate feedback

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

3. Third-Party Services

Castara uses the following third-party tools in the delivery of its services:

• HubSpot: Used for contact forms and meeting scheduling. Subject to HubSpot's Privacy Policy at hubspot.com/legal/privacy-policy
• GitHub: Used for version control and code storage. Subject to GitHub's Privacy Statement.
• VPS hosting provider: Used to host client websites. Server logs may be retained for up to 30 days for security purposes.

Castara is not responsible for the privacy practices of third-party services. We recommend reviewing their policies independently.

4. Data Retention

We retain your contact information for the duration of our business relationship and for a period of up to 2 years following the end of your subscription. You may request deletion of your data at any time by contacting us at contact@castara.io. We will process deletion requests within 30 days.

5. Data Security

We take reasonable technical and organizational measures to protect your information from unauthorized access, loss, or disclosure. Client website data is version-controlled on GitHub with access restricted to authorized Castara team members only.

6. Your Rights

Depending on your location, you may have rights regarding your personal data including:

• The right to access the personal data we hold about you
• The right to request correction of inaccurate data
• The right to request deletion of your data
• The right to object to processing or request restriction
• The right to data portability

7. Children

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has submitted information to us, please contact us and we will delete it promptly.

Audit Trail

This website is version-controlled via GitHub. Every change to the codebase is timestamped and logged, providing a full audit trail of accessibility compliance from the original deployment date. This documentation is available upon request.

Known Limitations

We are not aware of any current accessibility barriers on this website. If you encounter any issues, please contact us immediately and we will address them within 5 business days.
